CFTC opens consultation on a federal framework for leveraged crypto markets
The U.S. Commodity Futures Trading Commission published an Advanced Notice of Proposed Rulemaking on October 5, 2026, opening a consultation on a possible federal framework for retail crypto-asset transactions involving margin or leverage.
The most important point is the status of the measure: an ANPRM gathers information and public comments that may shape future rules. It does not create immediately enforceable obligations and should not be treated as a final regulatory regime.
The initiative focuses on section 2(c)(2)(D) of the Commodity Exchange Act, which covers certain retail commodity transactions that are financed, margined or leveraged. The CFTC is asking how to address abusive practices, adapt safeguards to crypto markets and potentially codify a designated contract market subcategory for these transactions.
Reuters reported that the framework under discussion could give qualifying platforms a federal path for this specific type of activity, potentially reducing some of the current state-by-state fragmentation. Topics include anti-manipulation protections and reserve transparency. A broader mandate over the entire crypto spot market would still require action by Congress.
Public comments are due within 60 days of publication in the Federal Register. Only after that process could the agency decide whether to propose more detailed rules.
